Terms of Service
These terms govern your use of this website and any purchase you make through it. By placing an order you accept them. Please read them and keep a copy. They are written for sales to consumers in the United States.
1. Who you are contracting with
Trading name: Joel Seattle
Legal entity: Takeover Enterprises LLC
Registered address: 30 N Gould St Ste R, Sheridan, WY 82801, USA
Email: takeoverenterprises785@gmail.com
Joel Seattle is a trading name of Takeover Enterprises LLC, a limited liability company incorporated in the State of Wyoming, United States of America. We sell online only. We have no shop or counter you can visit, and no telephone line; email is the only way to reach us.
2. Who may order
You must be at least 18 years old and able to enter a binding contract, and you must give us accurate shipping and contact details. We deliver to addresses in the United States only.
3. How a contract is formed
Our product pages are an invitation to buy, not an offer. Your order is an offer to buy. A contract is formed when we send you an email confirming that your order has been accepted or dispatched. If we cannot accept your order — the piece is unavailable, we cannot deliver to your address, or the order looks fraudulent — we will tell you and refund you in full.
4. Prices and payment
All amounts are in US dollars (USD). Every decanter is $39.95, down from $199.75, and standard shipping is free to any US address. The amount you will be charged is set out in full on our Shipping page and shown again with your order total before you pay. We add no further charges of our own after checkout. Sales tax, where it applies to your order, is calculated and shown at checkout before you pay. You pay with the payment methods offered at checkout, and payment is taken when the order is placed. If a price on the website is obviously wrong, we will contact you before dispatch and you may confirm the order at the correct price or cancel it for a full refund; we will not simply charge you more than the price you agreed.
5. Description of goods
We describe our decanters and glassware as accurately as we can, including materials, capacity and dimensions. Screens vary, so the color and clarity of glass can look slightly different from the photograph, and hand-finished pieces vary slightly from one to the next. Our decanters and glasses are drinkware, not laboratory or food-storage equipment, and they are not oven, microwave or dishwasher safe unless the product page says so. If a piece is not as described, our Returns & Refunds page tells you what happens next.
6. Delivery, title and risk
Delivery times are on our Shipping page and are estimates, not guarantees. Risk in the goods passes to you when the goods are delivered to the address you gave us. Title passes to you when we have received payment in full. If we cannot ship within the window stated on our Shipping page, the FTC's Mail, Internet, or Telephone Order Merchandise Rule applies and we will offer you a revised date or a prompt refund, at your choice.
7. Cancelling and changing an order
Email takeoverenterprises785@gmail.com as soon as possible with your order number. If the order has not yet been prepared for dispatch we will change or cancel it and refund you in full. After dispatch, our Returns & Refunds page applies.
8. Returns
Our Returns & Refunds page forms part of these terms. It sets out the 30-day change-of-mind return we offer, and what happens when a piece arrives faulty, damaged, not as described or not the piece you ordered.
9. Warranties
Our written warranty is set out in full on the Returns & Refunds page, as the Magnuson-Moss Warranty Act requires. Nothing in these terms disclaims or shortens an implied warranty of merchantability or of fitness for a particular purpose where state law does not permit it, and nothing in these terms takes away a right or remedy that federal or state consumer protection law gives you. Any part of these terms that would have that effect does not apply to you to that extent.
10. Our liability
Subject in every case to clause 9, and to the extent permitted by law, we are not liable for loss that was not reasonably foreseeable, for loss caused by events outside our reasonable control, or for business losses, and our liability for any other loss is limited to the amount you paid for the order concerned. Where the law permits, our liability for goods is limited, at our election, to replacing the goods, supplying equivalent goods, repairing the goods, or paying the cost of doing any of those things. We do not exclude liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded.
11. Using the glassware safely
Decanters and glasses are glass. Do not pour boiling liquid into a decanter, do not put it on a stovetop or in an oven or microwave, and do not use a piece that is chipped or cracked. Wash by hand with lukewarm water. Keep glassware out of the reach of children. If a piece arrives damaged, tell us instead of using it.
12. Using this website
Use the website lawfully. Do not attempt to interfere with it, scrape it at a scale that burdens it, or use it to defraud us or anyone else. We may suspend access to a customer who does. We do not warrant that the website will be available without interruption or free from errors.
13. Intellectual property
The text, photographs, design and trademarks on this website belong to Takeover Enterprises LLC or to our licensors. You may view and print pages for your own personal use. You may not copy them for commercial use without our written permission.
14. Third-party links
Where we link to another website, we do so for information. We do not control those sites and are not responsible for their content or their privacy practices.
15. Privacy
Our Privacy Policy explains how we handle personal information, including your rights under the CCPA/CPRA and comparable state laws, and the disclosure of your information to recipients outside your state. It forms part of these terms.
16. Changes to these terms
We may change these terms. The version on this page when you place your order is the version that governs that order.
17. Complaints
Email takeoverenterprises785@gmail.com. We acknowledge complaints within 5 business days and answer in substance within 14 days. If we cannot resolve it, you may file a report with the Federal Trade Commission at reportfraud.ftc.gov or with the Attorney General of your state.
18. Governing law and disputes
These terms are governed by the law of the State of Wyoming, without regard to its conflict-of-laws rules. Nothing in this clause takes away your right to bring a claim in the state where you live, to bring a claim in small claims court, or to complain to a consumer protection agency. We do not require you to arbitrate, we do not waive your right to a jury, and we do not ask you to give up the right to take part in a class action.
19. General
If a clause of these terms is found to be unenforceable, the rest continues to apply. A delay by us in enforcing a term is not a waiver of it. You may not transfer your rights under these terms without our consent.
